What Chapter 160 says about PODs and storage containers

Chapter 160 of the Barrington Code is titled “Dumpsters, Roll-Off Containers and Storage Containers.” Section 160-3 and § 160-4 cover what it calls “storage container[s]” and name the “POD” directly. The rules fall into a few groups:

  • Street or right-of-way: no private party may place a storage container or POD on Borough property, a street or a right-of-way (§ 160-3).
  • Driveway, for a move: a storage container may be on a driveway or other suitably paved area for packing or unpacking goods when moving into or out of the property, for not more than 30 consecutive days.
  • Driveway, for renovation: a container may hold the owner’s or occupant’s goods during renovation or rehabilitation of the structure, from up to 10 days before the work starts to 10 days after it ends, and never for more than a total of 120 days.
  • Setback and base: a container on private property must be on a suitable base for stability and may not be within five feet of any property line, public sidewalk or other right-of-way for public access (§ 160-2D).
  • Responsibility: the property owner is responsible for compliance.
  • Penalty: a person convicted in Municipal Court is liable for the fines in § 1-1 of the Code, and each day is a separate violation. We did not look up the § 1-1 dollar figure, so we are not quoting one.

Section 160-2 sets the permit process for dumpsters and roll-off containers, and the Borough’s combined application extends it to storage containers: on private property there is no application fee, while a container on Borough property or a street carries a $25 permit fee, a $400 escrow for potential damage to Borough property, a 14-day permit, and a legal parking space approved by the Police Department and the Superintendent of Public Works. Renewals are considered by a new application and another $25.

The application, step by step

  1. Use the Borough’s application. The “Application for Dumpsters, Roll-Off Containers & Storage Containers” asks for the property address and owner, the container company and its phone, the purpose of the container, the location (driveway or street), and the delivery and removal dates.
  2. Check the box that matches your setup. Driveway: valid 30 days, no fee. Street: valid 14 days, $400 escrow and $25 permit fee.
  3. Understand the escrow. The form says the cost of repairs to Borough property, a street or a right-of-way is deducted from your escrow deposit. The Code says the full amount is returned if the Superintendent of Public Works finds no damage.
  4. Give us the approved dates. We deliver from West Deptford on your delivery date, put the container where your permit says, and collect it on the removal date.

Barrington describes itself as a borough incorporated in 1917, a suburb of Philadelphia of about 7,000 residents, with a long industrial history and companies such as FedEx and Edmund Optics inside its borders. For a homeowner, the practical angle is simple. The Code wants the container on your own paved driveway, back from lines and sidewalks.
