What Swedesboro’s code covers

We read the Borough of Swedesboro Code on eCode360 and the Borough’s website (historicswedesboro.com). We did not find an ordinance that names portable storage containers, PODs or storage units. What the Borough does regulate is dumpsters and similar items, and that is the rule most people hear about:

  • § 276-27 (Permit required): no one may place any “dumpster, oversized trash container or building materials on any public or private lands” without a permit. The permit is issued by the Construction Code Official after an application showing the exact location and purpose of the placement.
  • Police review: the application goes to the Chief of Police or a designee, who checks the safety and appropriateness of the location. The permit is for a specific space for a period not to exceed seven days, and under certain conditions may be extended after review by the Construction Code Official and/or code officer and the Police Department.
  • Fee: $25 (Chapter 140, Fees, § 140-27), by cash or check payable to the Borough.
  • Definition (§ 276-28): an “oversized trash container” is a receptacle with a capacity greater than 12 cubic yards or holding over two tons when filled.
  • Safe passage (§ 276-30): the placement must allow safe passage of pedestrians and vehicles along the public way.
  • Penalty (§ 276-31): a fine up to $200, up to 30 days in jail, or both.

A rented storage container is not a dumpster or a trash receptacle, so by its wording this article does not name it. We are not saying it is exempt: “building materials” and the permit language are broad, and the Code is not clear. The cautious route is to ask the Borough whether it wants a permit.

Permit, fee, form and who to call

Because no portable-storage ordinance was found, there is no direct link to a portable-storage application. The Borough’s Forms, Permits and Applications page lists forms such as the zoning permit application, planning/zoning board application, yard sale and food truck permits, but no dumpster or storage-container form. The Borough’s Construction page says construction permit packets can be picked up and dropped off at the municipal building at those hours. The Borough’s construction code work is handled under a shared services agreement with Greenwich Township.
